INFORMATION CLAUSE

regarding the processing of personal data by "Kuhn-Polska" Sp. z o.o.

In the light of the information obligations of the data controller who processes personal data to the data subject, resulting from the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free the flow of such data and the repeal of Directive 95/46 / EC (general regulation on the protection of personal data) ("Regulation"), we would like to inform you in a transparent way:

  • why and how we collect, use and store your personal data;
  • on what legal basis and for what purpose and how long this personal data is processed;
  • what are your rights and obligations related to the collection and use of such data.

Plonów 21, 41-200 Sosnowiec, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court for the Katowice - Wschód in Katowice, VIII Commercial Division of the National Court Register, under KRS number 0000240957, REGON: 140223444, Tax Identification Number: 5213356367, share capital in the amount of PLN 50,000.00 ("Data Controller" or "Kuhn-Polska").

In order to conduct its operations, Kuhn-Polska collects and uses information identifying individuals ("personal data").

In this information clause, Kuhn-Polska informs you of all forms of the use of personal data ("processing") in relation to natural persons who are:

  • clients, including potential clients;
  • suppliers of goods or services to Kuhn-Polska, subcontractors and other contractors, including potential suppliers, subcontractors and other contractors, Kuhn-Polska;
  • partners, employees, associates, statutory representatives, proxies or representatives of such clients, as well as suppliers, subcontractors and other contractors;
  • other people whose data we process for the purpose of issuing or implementing invoices in the framework of cooperation with clients, suppliers, subcontractors and other contractors ("You" or "Customers / Suppliers").

Kuhn-Polska is the Data Controller of your personal data collected in the process of acquiring Customers / Suppliers and the implementation of contracts concluded with Customers / Suppliers, which means that it determines the purposes in which these personal data are used and how they are processed.

Personal data are processed by Kuhn-Polska when (legal basis for processing):

  • it is necessary to perform the agreement to which the data subject is a party, or to take action at the request of the data subject before concluding the agreement (Article 6 (1) letter b of the Regulation);
  • it is necessary to fulfill the legal obligation incumbent on the Data Controller (Article 6 (1) letter c) of the Regulation);
  • it is necessary for purposes resulting from legally justified interests pursued by the Data Controller (Article 6 (1) letter f of the Regulation).

Your personal data will be used to execute agreements with you, as well as for complaints and possible redress. Your personal data will also be used to send commercial offers (so-called direct marketing) and to contact persons representing / acting on behalf of the Customer / Supplier.

In the case of concluding an agreement between you and Kuhn-Polska, providing personal data above the indicated persons is voluntary, but necessary for the purpose of concluding the agreement and handling the cooperation between the Customer / Supplier and Kuhn-Polska. The consequence of not providing personal data is the inability to perform the above actions by Kuhn-Polska (for example, failure to provide personal data may result in the invoice not being able to be raised).

Your personal data may be transferred to the following recipients (including other administrators processing personal data on their own):

  • entities operating postal or courier;
  • entities conducting payment activity (banks, payment institutions);
  • entities cooperating with the Data Controller while handling administrative, legal, tax, advisory, commercial matters, etc.;
  • entities that maintain servers and provide hosting, IT and other similar services to the Data Controller.

Your personal data will be kept by Kuhn-Polska for the period of:

  • in which legal provisions require us to store personal data (for example for accounting or tax purposes);
  • performance of obligations under trade agreements, including expiration of the period of limitation of claims arising from these agreements;
  • implementation of legitimate interests of the Data Controller, for example, pursuing claims by the Data Controller, direct marketing by the Data Controller, as well as contacting the persons representing / acting on behalf of the Customer / Supplier if it is necessary to conclude or execute agreements with Customers / Suppliers.

As the Data Controller of your personal data, we ensure that in connection with the processing of your personal data you have the right to:

  • require the Data Controller to access your personal data, including obtaining a copy of the data;
  • require the Data Controller to correct your personal data that is incorrect, incomplete, including by providing an additional statement;
  • require the Data Controller to delete data (only in situations specified in the Regulation, for example when they are not necessary for the purpose for which they were collected or otherwise processed, or were processed unlawfully);
  • requesting the Data Controller to restrict the processing of your personal data (for example, if the processing is illegal and the person whose data is opposed to deleting data, or if the Data Controller no longer needs personal data for processing purposes, and at the same time they need that person to investigate or defense of claims);
  • requesting the Data Controller to your personal data portability (if the processing of your personal data is necessary for the Data Controller to perform the contract to which you are a party and if such processing is automated), including sending such data to another data controller if it is it's technically possible;
  • object to the processing of your personal data by the Data Controller (in the event of personal data being processed within the legitimate interest of the Data Controller, e.g. in the case of processing for direct marketing purposes);
  • lodging a complaint to the supervisory body (the President of the Office for the Protection of Personal Data).

Your personal data is processed electronically and manually, in accordance with the methods and procedures related to the processing purposes mentioned above.

The Data Controller makes every effort to provide all means of physical, technical and organizational protection of your personal data against accidental or deliberate destruction, accidental loss, change, unauthorized disclosure, use or access, in accordance with all applicable regulations.
